Summary

    This book is written with three principal goals in mind. Firstly, it aims to distil and offer an authoritative synthesis of the key principles of criminal law in Singapore. Secondly, it seeks to identify issues (and nuances) in criminal law in Singapore for which the relevant principles are not so certain or which have yet to be clearly resolved, and for a number of such issues, to suggest the most appropriate way forward. Thirdly, it points out areas of criminal law in Singapore which are inextricably linked to other areas of criminal justice such as criminal procedure, assessment of evidence and sentencing law, so that the appropriate connections can be drawn.

     

    Foundations of Criminal Law in Singapore focuses on the fundamental issues and topics of criminal law which are generally applicable across different offences. It covers topics such as the essential principles of statutory interpretation in Singapore, jurisdiction, physical and fault elements of a crime, concurrence, strict liability, the more commonly pleaded general and special defences, liability for attempts, abetment, criminal conspiracy, and common intention. Overall, the book strives to strike a good balance between being practice-oriented and offering intellectual and academic stimulation. It is written in a simple and reader-friendly manner.

     

    It is therefore envisaged that this book will be an essential resource to anyone:

    (a) looking for a quick, practical and accessible guide to understand key principles of criminal law in Singapore,

    (b) wishing to gain a strong foundation in such principles, or

    (c) who has to grapple with certain issues and nuances in criminal law in Singapore which are yet clearly settled and require ideas and inspiration on how best to resolve them.

     

    Author bio: Benny Tan is Assistant Professor at the Faculty of Law, National University of Singapore (“NUS”). He graduated with an LLB from NUS and was placed on the Dean’s List in his final undergraduate year. He also holds an MPhil in Criminological Research from the University of Cambridge, for which he was awarded the Manuel López-Rey Graduate Prize for being overall top student in his cohort. He has experience as a deputy public prosecutor, as well as a defence counsel. At NUS Faculty of Law, Benny has taught legal skills courses to both undergraduate and graduate students, and currently teaches criminal law and evidence law.

     

    His areas of research specialisation include criminal law (in particular sentencing law and policy), and criminal evidence and procedure. He has also been awarded teaching excellence awards at the faculty and university level. Benny has published articles in various peer-reviewed journals, and has thrice won the Best Feature Article prize awarded by the Law Society of Singapore’s Law Gazette. Benny was also appointed by the Supreme Court of Singapore to the Young Amicus Curiae panel (2016, 2017), where he has been called upon to assist the courts in cases involving novel or complex issues of law.
