Community Law in Focus is a series of events seminars that offers audiences an insightful exploration of key areas in community law. The series opens with Academy Publishing’s newest publication, The Mental Capacity Act in Singapore: Law and Practice by Dr Colin Tan (NUS), Mr Chong Yue-En (Bethel Chambers), Mr Allen Sng Kiat Peng (NUS), and Mr Tan Kah Wai (LVM Law Chambers).

 

To mark the 15th anniversary of the enactment of the Singapore Mental Capacity Act (MCA), this seminar will delve into the legal framework designed to protect individuals aged 21 and above who lack the mental capacity to make decisions independently.

 

The four authors aim to provide a clear and practical understanding of the Act’s provisions and its evolving role in an ageing and more inclusive society. Key topics include assessing mental capacity, appointing decision-makers, and the safeguards in place to ensure the welfare and best interests of vulnerable individuals.

Protecting Those Who Cannot Protect Themselves: Insights Into The Mental Capacity Act

Tan Boon Chwee Colin is both a qualified lawyer as well as a qualified doctor, and he also holds a PhD in law. He served as a district judge in the Subordinate Courts and, later, the Family Justice Courts from 2010 to 2023. During his tenure in the Judiciary, he has held concurrent appointments such as Judge Advisor for Information Technology and Senior Director of the Singapore Judicial College’s Centre for Leadership and Judgecraft. 

Mr Chong Yue-En
Founder and Managing Director
Bethel Chambers


Chong Yue-En is the founder of Bethel Chambers LLC with his practice specialising on private clients, mental capacity, probate and estate and family law, serving both international and Singaporean families. He has an LLM from Cardiff University focusing on mental capacity law. He is an accredited professional deputy and donee with the Singapore Office of the Public Guardian. He is also a full STEP member and the current elected Global Chairperson of STEP Mental Capacity Special Interest Group.

Mr Allen Sng
Adjunct Research Fellow
Centre for Banking & Finance Law
National University of Singapore


Allen is a civil servant on the Public Sector Leadership Programme. He is a member of the SAL Law Reform Committee and an adjunct research fellow with the NUS Centre for Banking and Finance Law. Allen led the National University of Singapore’s Assisted Deputyship Application Programme (2015–2022) and now pursues his pro-bono interests as advisor to the Singapore Management University’s Project Ageing. 

Mr Tan Kah Wai

LVM Law Chambers


Tan Kah Wai is a Senior Associate at LVM Law Chambers LLC. He graduated with a Bachelor of Laws (First Class Honours) from the National University of Singapore, as well as Master of Laws (International Business Law) from King’s College London. Not only does he maintain a specialist practice in mental capacity disputes, he is also a prolific academic writer whose published works on mental capacity law are regularly cited in various local and international journals.
