The push for collaborative contracting in the construction industry represents a significant shift from traditionally adversarial and fragmented relationships to a better integrated and co-operative approach. It was in response to the need for a better alignment of interests and avoidance of disputes, as project participants work towards common project goals.

 

While the evolution of the industry towards one of collaboration is progressively taking root in Singapore, the mindset, behavioural and cultural shift towards a collaborative approach in the UK had an earlier start through revisions of the New Engineering Contract (NEC) and the introduction of the Integrated Project Delivery method. In Hong Kong, relational contracting, as it is better known, has been a common feature in public works in the past decade.

 

Referencing case studies, the distinguished panel, comprising of legal and project specialists, will take an honest look at how collaborative contracting has performed in delivering what it promises – quality projects that are completed on time and within budget - and how the industry can meaningfully adopt these practices that would result in delivering successful construction projects.

J. Sathia is Co-Head of Allen & Gledhill’s Construction & Engineering Practice.  Sathia is the youngest amongst a select group of lawyers ranked in Band 1 for Construction in Chambers Asia-Pacific and as a Leading Individual for Construction in The Legal 500 Asia Pacific.  He is a board member of the Building and Construction Authority. Sathia is recognised as a Senior Accredited Specialist in Building and Construction Law by the Singapore Academy of Law, is a Principal Mediator with the Singapore Mediation Centre, has been appointed as arbitrator in ICC, SIAC and ad hoc international and domestic arbitrations and as an adjudicator under the Security of Payment Act.


His area of practice encompasses a wide range of contentious and non-contentious work in building, construction, engineering and infrastructure projects. On the contentious side, Sathia regularly appears as counsel for statutory boards, government-linked entities, international developers, contractors and consultants in complex and large-scale domestic and international arbitration, litigation, adjudication and mediation concerning construction, engineering and infrastructure disputes. On the non-contentious side, he regularly advises on tender and project documentation under various procurement models in relation to the built environment.

Lip San is a partner in the International Arbitration Practice and Construction & Projects Practice at Rajah & Rann Singapore LLP. He was named as a Senior Accredited Specialist for Building and Construction Law in the inaugural batch of the Singapore Academy of Law’s Specialist Accreditation Scheme.

He has expertise in advising board level executives in various major organisations on innovative procurement strategies, commercial models, contract drafting, project risk management, dispute management, cost assurance and major project delivery. He is also a claim specialist and has been appointed as independent expert.

An expert in collaborative contracting, NEC, contractual joint ventures, sustainability and digitalisation in construction, Anne-Marie has advised on some of the UK’s most important projects including HS2, A14, Crossrail, M4, Thames Tideway Tunnel, Lee Tunnel, among others as well as advising on a range of other projects around the world. She is also a strategic advisor to the UK’s Digital Twin Hub and is a steering group member of the Net Zero Infrastructure Industry Coalition.
