This is the first of the author’s integrated discussion of the theory, substantive principles, definitive judicial decisions and procedural rules of the family law in Singapore. It aims to present sound overview of how the substantive law as operationalised by the Family Justice Courts work together within these topics.

 

This latest series is culmination of the author’s own learning towards appreciating theory, substance and procedure in a woven tapestry. Each part plays its role in achieving family law’s goal of inspiring loving and durable familial relationships.

This monograph aims to discuss formation of non-Muslim marriage and the law regulating aspects of the marital relationship, including divorce and division of matrimonial assets, so the issues within each topic are handled in such integrated manner. The main statute is the Women’s Charter 1961 (2020 Rev Ed). There have been significant amendments of the law by the Women’s Charter (Amendment) Act 2022 (Act 3 of 2022), the Family Justice Reform Act 2023 (Act 18 of 2023) and the Women’s Charter (Family Violence and Other Matters) (Amendment) Act 2023 (Act 21 of 2023) … The new Family Justice (General) Rules 2024, together with the Family Justice Courts Practice Directions 2024 and new court forms, as well as the Family Justice Courts’ Therapeutic Justice Model 2024, are also operative from October 2024. Underlying theory, substantive principles of law and selected procedural rules will be presented to offer a grand visual of legal principles and how they are optimally operationalised by the Family Justice Courts in Singapore.
