This issue reviews important Singapore arbitration-related court decisions from January to June 2020 on attempts to set aside arbitral awards. Accompanying case notes examining the significance and relevance of these and other Singapore cases reported are included in this issue. There is also an extended single article by Toby Landau QC – “Arbitral Groundhog Day: The Reopening and Re-Arguing of Arbitral Determinations” – which critically and exhaustively reviews the resultant complex issues when a party seeks to have a claim adjudicated in one forum, which has already been determined in another.

Amongst the noteworthy judgments are the Singapore Court of Appeal decisions in BNA v BNB [2020] 1 SLR 456 and ST Group Co Ltd v Sanum Investments Ltd [2020] 1 SLR 1 in relation to issues such as the seat of arbitration and the governing law and validity of the arbitration agreement. The two learned articles in this issue explore thorny issues such as corruption in international arbitration and confidentiality in the arbitration process.

The rationale for this book is two-fold. First, there have been recent changes to the Penal Code 1871  (“Penal Code”) in 2019  and more recently in 2022.  Apart from the stiffening of sentences in respect of, among others, the offence for outrage of modesty which is “probably the most common [sexual] offence”,  new offences were introduced, including offences intended to tackle emerging and evolving technology trends (such as voyeurism-related offences and the offence of sexual communication with a minor below 18 years of age); offences to increase protection for minors aged 16 to 18 where there is an element of sexual exploitation; and offences relating to child abuse material (for which there was only previously a “patchwork of laws” to address such offences). … It is fair to say that the criminal landscape on sexual offences has significantly evolved in recent years and this book seeks to, among other things, explore and analyse these material developments.
