Venue: SAL, Stamford 1 & 2, The Adelphi #08-08, 1 Coleman Street (S179803)The course covers contentious issues that regularly occur in building construction projects and disputes: payments and variations; time and delays and termination. It also covers other practical aspects of the built industry such as construction programmes. Each session covers the legal principles and developments pertaining to these issues with a tutorial thereafter. Participants can also expect to be guided on the practical aspects of the construction dispute process: cause papers, witness selection and conferencing, use of experts, Scotts Schedule, written submissions and preparing document bundles.
The workshop takes place over two days:
DAY 1
Module 1: Construction Lawyer’s Toolkit
This session deals with the matters commonly encountered in construction arbitration, adjudication and litigation: the preparation required and expected of construction lawyers, selection of arbitrators, use and selection of expert witnesses, preparation of Scott Schedules, documents available for discovery, witness conferencing and the preparation of bundles of documents. Participants can also look forward to hearing from Mr Adrian Kong, Managing Director of Ankura, on delay analysis and delay experts.Module 2: Payments and Variations
The session covers both the theoretical and practical aspects of claim preparation for payment and variation claims. These would include pointers on preparation of claims in accordance with the requirements of the contract, providing the necessary substantiation for valuation and how factual and expert evidence on such claims can be led or produced in adjudication and other hearings.DAY 2
Module 3: Time and Delays and Construction Programmes
Everyone construction project will specify a date for construction of the works i.e. the contract completion date. However, delays on construction projects are inevitable. All standard form construction contracts contain provisions to address this scenario and allocate the risk between the owner and the contractor. This session covers legal concepts unique to construction projects, namely, concepts such as extensions of time, acts of prevention and time at large. It also discusses the consequences of the contractor being late in completing the works and the remedies available to the employer, namely, the right to impose liquidated damages for each day of delay.This session will also cover construction programmes, the information that goes into one and how they might be designed and incorporated into a contract document.
Module 4: Post-Completion and Termination
This session examines the requirements to achieve completion of the construction works and the consequential obligations imposed on the Contractor post-completion.It will cover termination under building contracts: the rights available to both the Employer and the Contractor to terminate the contract, the concept of the termination of the employment of the contractor, the usual disputes which arise following termination, the procedure to be complied with to effect a valid termination under the Contract and general law and the effect of both a valid and invalid termination on the rights and obligations of the Parties. There will also be a discussion on the provisions relating to termination under the various forms of building contract in use in Singapore.

He will discuss how to contribute 'value-added' to the overall teamwork, develop and make the best use of specialist skills and knowledge, anticipate and prepare for tasks which may arise at short notice, respond to such tasks effectively and speedily, when to speak up and when to keep silent, how to watch, listen and learn - and so in turn to become a senior advocate and practitioner.
Justice Soole will be joined by panellists comprising young lawyers practising in varying set-ups, such as a conventional large firm, a boutique litigation practice and a Singapore-style barrister chambers. This diverse panel will provide a range of perspectives on the experiences of young advocates in today’s legal profession.
