Annual Review of 2021 Cases on Equity and Trusts

There were several judgments delivered during the year 2021 which raised a number of interesting points.  The authors of this Chapter on Equity and Trusts will share their review and analysis of the cases which dealt with, amongst others, declaration of trusts and responsibilities of trustees. This session will also consider the lessons learned from litigation in relation to family and jointly held properties from the cases of Lee Kim Song v Chan Chee Kien [2021] SGHC 6, Lim Sze Wei (the joint executor and trustee of the estate of Mrs Lim Ah Fong née Loh Ah Fong, deceased) and another v Lim Chuan Wei [2021] SGHC 267, Tay Nguang Kee Serene v Tay Yak Ping and another [2021] SGHC 19 and Lim Choo Hin (as the sole executrix of the estate of Lim Guan Heong, deceased) v Lim Sai Ing Peggy [2021] SGHC 52. The Court of Appeal’s recent landmark decision on trusts and HDB flats in Ong Chai Soon v Ong Chai Koon and others [2022] SGCA 36 will also be discussed.
