How have Singapore’s courts navigated the evolving and often contentious landscape of division of matrimonial assets upon divorce? Through an extensive empirical study of matrimonial cases in Singapore, this monograph offers fresh insights into the historical and jurisprudential development of the division of matrimonial assets in its courts. It examines how legal reforms – from the Women’s Charter amendments in 1980 and 1996 to the “structured approach” introduced in ANJ v ANK (2015) – have influenced judicial practices in this area of Singapore family law. By drawing on comprehensive datasets on local matrimonial cases, it proposes a principled methodology for equitable asset division grounded in partnership law principles. Essential reading for family law judges and practitioners, policymakers, and social workers, this work is a key resource for stakeholders in the family law community in Singapore.

The book offers a detailed examination of Singapore’s legal and policy framework for cybersecurity, starting with an overview of the Cybersecurity Act 2018, complementary legislation, and national strategies for resilience and innovation. Subsequent chapters address common attack vectors and vulnerabilities that lawyers ought to be aware of, legal issues connected with responses to a cybersecurity incident, civil liability and remedies stemming from cybersecurity incidents, as well as civil liabilities of victims of cybersecurity incidents and alternative dispute resolution.

The final chapters look into the objectives of computer-related offences, and provide reflections on Singapore’s cybersecurity approach and legal framework as well as the challenges policy and law makers face in the fight against increasingly sophisticated cyber criminals.

  5. Tort Of Defamation Before The Singapore Courts 1965–2015 :A Comparative and Empirical Study

Based on data collated concerning defamation cases decided by the Singapore courts from 1965 to 2015, this monograph assesses the trends in the courts’ use of foreign decisions and the diverse origins and nature of the foreign sources. In addition to the research methodology, it discusses the comparative law literature relating to such use of foreign precedents by judges and their contributions to the transnational judicial dialogue. Lawyers and judges may also be interested in the comparative analysis of the defamation laws of the selected foreign jurisdictions (England, Australia, Canada, New Zealand, Malaysia and Hong Kong) as well as the specific legal issues (namely, defamatory meaning, reference to plaintiff and publication, the legal defences to defamation, the remedies and conflict of laws). This book not only reflects upon the past 50 years of legal evolution, but also looks ahead to the potential challenges and prospects for the development of the tort of defamation in Singapore.

The law of legal professional privilege is of immense importance to clients, in-house counsel and external lawyers. This is the first publication which undertakes a critical evaluation of existing rules of legal professional privilege both in Singapore and across Commonwealth jurisdictions. It draws on applicable legislation, case law and academic commentary, and seeks to provide the reader with a sound doctrinal and analytical framework with which to approach the different aspects of this subject, as well as practical advice on how to assert and defend claims of privilege.

  7. Juvenile Justice – Where Rehabilitation Takes Centre Stage

This edition is currently not in print.

Our new edition: Youth Justice in Singapore has been released, and it is available for purchase here.

The guiding philosophy of the juvenile justice system is that the rehabilitation of the juvenile offender is the best way to prevent him from re-offending. The task of rehabilitation involves re-integrating the juvenile offender with his family and the community. It requires him to take responsibility both for his wrongdoing and his future. This is an effort involving many parties, not least the juvenile offender himself. This book explores the roles played by the various parties in the rehabilitation of the juvenile offender, including probation officers, social workers, institutional staff, his school, parents, extended family, and so on. It also covers the legal principles, case law, procedures and processes in the arena of juvenile crime, and shows how the juvenile justice system is designed to advance and promote the rehabilitation philosophy.

  8. International Issues in Family Law In Singapore

The “globalisation” of families has raised complex legal issues affecting family life, marriage and divorce. Yet there are relatively few local decisions in Singapore on the private international law aspects of family law. This book discusses conflict of laws rules applicable in family cases in Singapore and relevant local cases that offer guidance on the issues addressed. It also examines substantive law on family issues that have international features. Not quite a book on the conflict of laws nor the traditional topics in family law, its chapters uniquely select family law issues that have international dimensions. It includes discourse on substantive law and the conflicts rules in the formation of marriages, regulation of the marital relationship, matrimonial proceedings terminating marriages in globalised families, the ensuing financial consequences, and the laws on parental abduction and relocation of children across jurisdictions.
